Calmer Canines Ltd: The Legal Bits

These are the terms and conditions applicable to your purchase of a dog training programme, behaviour modification programme or dynamic dog assessment (the Programme) from Calmer Canines Ltd (me), trading as Calmer Canines, The Shouty-Barky Dog Lady and/or Thoughtful Paws Dog Training.

Your Programme will involve me working with you and making recommendations to you for your dog; these terms and conditions are designed for your protection and to help ensure you get the most from your Programme.

In purchasing the Programme, you agree to:

Allow me to share images or video footage of our sessions, including to my Business Social Media pages, or in my online training materials. If you wish to opt out, please let me know by email to stephie@CalmerCanines.co.uk 

Ensure that you do not attempt to train, advise or otherwise disseminate teaching to others.

Adhere to: 

  • my welfare policy. I do not endorse or utilise aversive equipment including, but not limited to prong collars, shock collars, sprays and rattle cans.

  • my behaviour policy. Where your Programme involves group work, you commit to behave in a way conducive to productive group sessions. To achieve the best possible results, you commit to following the Programme directives. Where an instruction is to be regarded as a directive, I will make this clear to you by using the capitalised words MUST DO or MUST BE.

  • my honesty policy. You must provide honest and truthful responses to my questions about your dog and its history, and keep me updated of changes that have a material impact on its participation in the Programme.

  • my content policy. All Programme materials made available to you remain my intellectual property, and you agree not to share or publish any such materials without my prior written permission. You are permitted to use and view the materials for personal, non-commercial use. You agree that you will not modify, copy, sublicence or transfer my materials in any way. You understand that your licence to use and view my materials will automatically terminate if you violate this policy.

  • my payments policy. You understand that your payments will be automatically administrated according to your selected plan. You understand that multiple failed attempts to take payment may result in termination of your Programme.

I reserve the right to curtail and/or sever programmes with clients who fail to adhere to these Policies at my sole discretion and without offering a refund for payments already made. Outstanding fees will be cancelled.

You agree that all bank transfer and currency exchange fees arising from this agreement shall be borne by you. Each of us will bear our own tax liabilities arising from the agreement.

If I elect to give you a discretionary refund, you agree that as above bank fees and currency exchange fees shall be borne by you.

Bring any concerns to my attention in the first instance. I am committed to providing a professional service. I will consider any request for reasonable and justifiable adjustments on the condition that they can be accommodated in line with my policies on welfare and confidentiality, and within the framework of our agreed Programme.

Acknowledge that I am not qualified to provide veterinary or nutritional therapeutic advice. Any information given in relation to these topics is not to be relied upon as such.

Let me know if you need to cancel as soon as possible, by email. I will make every effort to reschedule your Programme as quickly as possible, but I cannot guarantee the time period within which this will be possible, as this is dependent on my capacity at the time of your cancellation.  

Provide honest and truthful information about your dog, including its breed. For insurance reasons I cannot work with breeds that are banned under UK legislation, or with breeds subject to upcoming bans in UK law.

Use your brain- I will advise you on risks and benefits, but you understand that it is up to you to decide whether to proceed with the advice offered!

Agree to the waiver! 


With your purchase of the Programme, I agree to:

Provide the Programme to a high professional standard. Please be aware that your individual Programme is a living document and its contents may be subject to change. As each dog is individual, training or behaviour modification is acquired at different speeds – I make no guarantee on individual outcomes, and I do not predict outcomes for individual dogs, but work with you to achieve change.

Maintain your privacy to a professional standard, and ensure that I have systems in place to curate and safeguard your personal information.  I am fully GDPR (The General Data Protection Regulation) compliant. This means: 

  • The personal data I collect may include your name, address and wider contact details, and data relating to your animal’s training needs and training progress. These details will not be shared without your permission or sold to other organisations or used maliciously in any way. 
  • Any information or videos about you or your dog will be digitally stored on password protected devices and your consent given or not given will be complied with.  
  • Your data will be used to manage future communications between us including my products and services.  You can opt-out of receiving such communications by emailing Stephie@CalmerCanines.co.uk   
  • You can ask to view your dog’s file at any time.  Your information will be kept for a period of seven years after the last training contact was made, to ensure compliance with the UK’s Statute of Limitation.

Make every effort to reschedule your outstanding appointments within 2 months from your last due appointment in the event that I need to cancel. Should I consider the proposed delay to be detrimental to your dog's welfare, I will refer you to an alternative Practitioner(s) and refund any pre-paid sessions.


And we both agree that:

The Terms of this Agreement, together with the Risk Assessment and Waiver, constitute the entire agreement between us and supersede any prior or contemporaneous written, oral or implied agreement related to the Programme.  If any of this agreement is unenforceable such portion shall be severed and the remainder of this Agreement shall be fully enforceable.

The construction, interpretation and application of the terms and this Agreement are governed by the Laws of England, UK without regard to its conflict of law rules.  

I may revise these terms of use for my services at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.  

My Programme materials are provided 'as is'. Neither me nor my suppliers will be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the Programme materials. My Programme materials could include technical, typographical, or photographic errors. I make all reasonable efforts to ensure that the Programme materials are accurate, complete, and current, regularly updating my Programme materials without notice. I do not, however, make any commitment to update the materials.  

Where I provide you with links to sites, you accept that I have not reviewed all of the sites linked, as third party content is out of my control. I am not responsible for the contents of any linked site. The inclusion of any link does not imply my endorsement and use of links is at your own risk.  


The Waiver
 
You understand that dog training is not without risk to yourself, to members of your family, or to guests who may attend, or to your dog(s). Risks include, but are not limited by, the attached Risk Assessment.

You confirm that you have read the Risk Assessment and will comply with the outlined actions you may be required to undertake.

You will make me aware of any hazards in the remote training environment on an ongoing basis.

You agree to indemnify me, and hold me harmless, from any and all liability, loss, or damage which may be alleged to have been and/or have been caused directly or indirectly to any person, dog, or thing by your act or omission, or the act of your dog(s) whilst in training.

You understand that my professional indemnity and public liability insurance does not extend to training that you undertake without my supervision and presence (whether online or in person).

You acknowledge that you have read this Agreement and that you are entering into it voluntarily and with full understanding of the terms contained herein. You further agree that this Agreement is binding for this and all subsequent classes, events, and/or functions you attend.


Risk Assessment

Assessment reviewed: Friday 9th December  2022 The purpose of this assessment is to identify any risks to clients during online dog training activities and to identify and address any action deemed to be necessary to reduce and control the risks identified.
