Calmer Canines Ltd: The Legal Bits

Calmer Canines programmes and membership Terms and conditions

These are the terms and conditions applicable to your purchase of a dog training programme, behaviour modification programme, functional movement assessment, or Calmer Canines Club membership (together referred to as the Programme or membership, as applicable) from Calmer Canines Ltd, trading as Calmer Canines and The Shouty-Barky Dog Lady.

These terms are designed for your protection and to help you get the most from your Programme or membership.

By purchasing, you agree to the following.

1. Enrolment and payment

Programmes
Enrolment is confirmed once payment has been received in full, or a payment plan has been agreed and the first instalment paid. Payment plans must be honoured in full. Multiple failed payment attempts may result in suspension or termination of your Programme.

Calmer Canines Club membership
Membership is a recurring subscription, billed automatically at the frequency you selected at sign-up. Your membership begins as soon as your first payment is processed. Failed payments may result in suspension of your membership access.  All bank transfer and currency exchange fees arising from this agreement are your responsibility. Each of us will bear our own tax liabilities. Any discretionary refund will also be subject to these deductions.

2. Cancellations and rescheduling

Programmes
Please let me know as soon as possible if you need to cancel, by email. I will make every effort to reschedule as quickly as possible, though I cannot guarantee a timeframe as this depends on my capacity at the time.

If I need to cancel, I will make every effort to reschedule your outstanding appointments within 2 months. Should I consider any proposed delay to be detrimental to your dog's welfare, I will refer you to an alternative practitioner and refund any pre-paid sessions.

Calmer Canines Club membership
You may cancel your membership at any time. On cancellation, your access will continue until the end of your current billing period, after which it will not renew. No partial refunds are given for unused time within a billing period.

3. Access to content
Access to Programme materials is provided for the lifetime of the Programme. This is not the same as your lifetime.

Access to Club content is available for as long as your subscription remains active. Access is provided via third-party platforms and may change if those platforms are updated, replaced, or unavailable.

The Calmer Canines Club includes a mix of content, community, and live sessions. Live session schedules may vary and are subject to change. Details of upcoming sessions will be communicated via the platform.

4. What you agree to

Welfare
I do not endorse or use aversive equipment, including but not limited to prong collars, shock collars, sprays, and rattle cans. You agree to work within this policy.

Conduct
You agree to engage respectfully in all live sessions, community spaces, and group discussions. Where your Programme involves group work, you commit to engaging in a way that supports a productive environment for everyone. Where an instruction is a directive, this will be made clear using the words MUST DO or MUST BE.

Confidentiality
Please do not share personal or case information shared by others outside of the community space. What's shared in the Club stays in the Club.

Honesty
You agree to provide honest and accurate information about your dog, its history, and its breed, and to keep me updated of any changes that have a material impact on the Programme. For insurance reasons, I cannot work with breeds banned under UK legislation or subject to upcoming bans in UK law.

Content
All Programme and Club materials remain the intellectual property of Calmer Canines Ltd. You may use and view them for personal, non-commercial use only. You agree not to share, copy, modify, sublicence, or transfer any materials without my prior written permission. Your licence to use the materials will terminate automatically if you breach this policy.

Images and video
You agree that I may use images or video footage from our sessions in my business social media or online training materials. If you would prefer to opt out, please let me know by email at Stephie@CalmerCanines.co.uk.

Professional boundaries
You agree not to attempt to train, advise, or disseminate teaching to others based on Programme or Club content.

Your judgement
I will advise you on risks and benefits, but you understand that decisions about whether to act on any advice rest with you.

5. What I agree to
I will deliver your Programme and Club content to a high professional standard. Please be aware that Programmes are living documents and may evolve. Because every dog is individual, progress is acquired at different speeds. I make no guarantee of specific outcomes and do not predict outcomes for individual dogs, but I will work with you to achieve meaningful change.

I will maintain your privacy to a professional standard and ensure your personal data is handled in line with UK GDPR. Please see our site-wide terms for full details of how your data is collected, stored, and used.

6. Concerns and complaints
Please bring any concerns to my attention in the first instance. I am committed to providing a professional service and will consider requests for reasonable adjustments, provided they can be accommodated within my welfare and confidentiality policies and the framework of your agreed Programme or membership.

7. Disclaimer
I am not qualified to provide veterinary or nutritional therapeutic advice. Any information given in relation to these topics should not be relied upon as such.

Programme and Club materials are provided in good faith. I make all reasonable efforts to ensure they are accurate, complete, and current. Neither I nor my suppliers will be liable for any damages arising from the use of or inability to use Programme or Club materials. Where I provide links to third-party sites, I am not responsible for their content and inclusion of any link does not imply endorsement.

8. The waiver
This section applies to Programmes involving active training work.

You understand that dog training is not without risk to yourself, members of your family, guests, or your dog. By purchasing the Programme, you confirm that you have read and will comply with the Risk Assessment provided.

You will make me aware of any hazards in your training environment on an ongoing basis. You agree to indemnify me and hold me harmless from any liability, loss, or damage caused directly or indirectly by your actions, omissions, or those of your dog while in training.

You understand that my professional indemnity and public liability insurance does not extend to training you undertake without my supervision or presence, whether online or in person.

9. General
These terms, together with the Risk Assessment and Waiver where applicable, constitute the entire agreement between us and supersede any prior written, oral, or implied agreement. If any part of this agreement is unenforceable, the remainder continues in full effect.

I reserve the right to suspend or terminate access for anyone who fails to adhere to these terms, at my sole discretion and without refund for payments already made. I may revise these terms at any time. Continued use following any revision constitutes acceptance of the updated terms.

These terms are governed by the laws of England and Wales. Calmer Canines Ltd, 22 Derby St W, Ormskirk, L39 3NH. Questions? Stephie@CalmerCanines.co.uk
